PRIVACY POLICY

We at Nine After want to provide you with a safe and enjoyable experience on our Site.  This Privacy Policy describes the type of personal information we may collect from you, how such information may be used, and your options concerning the use of your information.  By using the Site, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy, and agree to the Terms of Use, which are incorporated by reference. If you do not agree, please do not access or use the Site.  Capitalized terms not defined here are defined in the Terms of Use.  

 

  1. Personal Information: “Personal Information” means any information which can identify you, such as your name, email address, physical address, or telephone number.  Your Personal Information is collected from information you provide to us, transaction information, information from data collection technologies, and information about you from third-party sources.  Each of these sources of Personal Information is discussed below.

  • When you order products using our Site, you voluntarily provide your Personal Information including credit card or other payment information.   You are also voluntarily providing Personal Information when you participate in promotions or surveys, or when you call for customer assistance.  We also collect your Personal Information through your shopping history and preferences.

  • When you use or access our Site, our servers may automatically collect certain information about your visit, including your IP address and browser information.  We may also use cookies, web beacons, pixel tags, log files, or other technologies to collect certain information about visitors to our Site, and interactions with our emails and online advertisements, for analytics and statistics about our marketing efforts.  Data from these technologies may, by itself, not be personally identifiable, but may become Personal Information when combined with other personal information through your purchases and preferences.   

  • We may collect data about your location through geolocation (if enabled), or through cell towers and WiFi hotspots.  

  • We may also receive Personal Information about you from publicly available sources, joint-marketing partners, or credit providers who require Personal Information to determine your creditworthiness.

 

    2. How We Use Your Personal Information

 We use Personal Information for the following purposes:

  • to provide the products we offer and perform and improve our core business operations, such as operating the Site, confirming and tracking your Order, processing payment transactions, maintaining records of your purchases, and contacting you about your Orders.

  • To measure the Site performance and improve the effectiveness and performance of our Site, customer service, advertising, and customer shopping experience.

  • To use your data in an aggregated non-specific format for analytical and demographic purposes.

  • To deliver and personalize our communications with you including sending you an email or other means to provide you promotional materials, communicate about orders in process and returns, remind you about items left in your cart, handle a return request, or tell you to take action to keep your account active.  You can always opt-out of these communications in accordance with the Opt-Out Choices below.   

 

    3. How We Share your Personal Information with Third Parties

  • We may share your Personal Information with the product vendors/brands when you order a product so they can process the Order for delivery. 

  • When you purchase a product, we may share your Personal Information with payment processors that process payment transactions or provide other financial services, and for fraud prevention and credit risk reduction.

  • We may share your Personal Information with marketing and data analytics companies.  In these instances, these companies are only authorized to use Personal Information they receive from us only for the specific purposes for which they are engaged.   We may also share or sell aggregate or anonymous information with these third parties. This type of non-identifiable and aggregate information cannot be used to identify you personally.

  • We may share your Personal Information to comply, or in accordance, with the law or when we believe the law requires us to share this information. 

  • We may share your Personal Information as part of a corporate transaction such as a merger, consolidation, restructuring, reorganization, or sale of some or all of Vivie’s assets or as part of an insolvency proceeding, where such Personal Information may be among the assets transferred or consolidated.

 

   4. Accessing and Updating your Personal Information

When you create an account, you may view your account information by logging on to your account.  You may also email us at [email protected]  to obtain your account information.  We may also use social media platforms to communicate with our customers. If you contact or interact with us through our social media accounts, we may contact you via direct message or use other tools to communicate with you. Our interactions with you through these accounts are governed by this Privacy Policy as well as the Privacy Policy of that specific social media provider. 

​   5. Cookies, Web Beacons, And Other Technologies 

 Vivie uses technologies such as electronic communication protocols, cookies, embedded URLs or pixels, or widgets, buttons, tools, web beacons, and "tag" technology to enhance the browsing and shopping experience on our Site.

Cookies are small files or records that we place on your device to collect information about your activities on our Site.  They will not collect your name, address, and payment card details.  Cookies help us understand and fix technical errors on our Site. Cookies also make our Site and your device able to work together. 

Web beacons and tags are small strings of code that are used in conjunction with a cookie and that allow us to record activity on our Site.

Neither cookies nor web beacons and tags store Personal Information.

   6. Marketing and Advertising 

 We may use your Personal Information to provide tailored advertising to you on the Site, or on our social media channels.  We may use third-party vendors to assist in analyzing information about our Site visitors. These vendors are bound by confidentiality and are not authorized to use your Personal Information for any purpose other than the purpose for which we specifically contracted them.

These third-party vendors may connect information about your activity with Vivie with information about other web pages you may visit or social media channels you use to show you relevant advertising.

Some of our advertising and analytics services vendors may be members of the Network Advertising Initiative (“NAI”) or Digital Advertising Alliance (“DAA”). You can visit optout.networkadvertising.org, which provides information regarding targeted advertising and the opt-out procedures of NAI members. You can also visit optout.aboutads.info, which provides information regarding targeted advertising and offers an opt-out for DAA-participating companies.

We use Google Analytics, which uses cookies and other similar technologies to collect and analyze information about use and report on activities and trends. You can learn about Google’s practices by going to google.com/policies/privacy/partners, and opting out of them by downloading the Google Analytics opt-out browser add-on, available at tools.google.com/dlpage/gaoptout.

Please note opting out may not opt you out of non-targeted advertisements while online.

 

   7. How To Opt-Out from Communications from Vivie

Vivie only sends marketing communications to you and other customers who agree to receive them. If you wish to opt-out from receiving these marketing communications, please follow the steps below:

From email marketing:

  • Click the “Unsubscribe” link in any of our marketing emails you receive.

  • We will remove you from the marketing lists within _____ days of our receipt of your opt-out or unsubscribe request.

From social media:

  • Please follow the instructions provided by the particular social media platform to opt-out of communications with us on social media. You are solely responsible for following the opt-out process of each social media platform.

Your choice to opt-in or opt out of the marketing communications described above will not affect any Orders with us or any account you have registered with us. 

 

   8. Do Not Track

 We do not directly track its customers over time and across third-party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals. However, some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, your browser may allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

   9. Children’s Privacy

Nine After is intended for use by individuals who are at least 18 years of age or older. It is not directed towards children under the age of 13. We do not knowingly collect personal information from children under 13. If you are under 13, please do not provide any personal information on our website or through any of its features. If we discover that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.    10. Data Security

Nine After takes the security of your personal information very seriously. We only collect the minimum necessary information required for a seamless app experience and e-commerce functionality. All traffic transmitted to our servers uses Secure Socket Layer (SSL) technology. All stored user information is encrypted using the latest industry-standards. We strictly share only the necessary information with an order’s Shopify Merchant for the order to be fulfilled. Nine After does not store credit card information. Payments are handled by Stripe, a PCI compliant payment processor. We implement regular security reviews and updates to our systems to stay ahead of potential threats.

   11. Updating the Privacy Policy

 We may from time to time update our Privacy Policy to reflect changes in our privacy practices. We will inform you of any update to our Privacy Policy by posting a notice on our Site. The effective date of the updated Privacy Policy will be the date posted on the notice and shall replace prior versions of the Privacy Policy.  

 

   12. US State-Specific Privacy Policies

We are committed to adhering to state-specific privacy policies and regulations that may apply to our operations. As laws regarding data protection and privacy vary by state within the United States, we strive to ensure that our practices align with the requirements of each jurisdiction where we conduct business. Our privacy practices may be tailored to meet the specific requirements outlined by states such as California, Nevada, and others, as applicable. We regularly review and update our privacy policies and practices to remain compliant with evolving state laws and regulations concerning data privacy, security, and consumer rights.
